PlusOne Terms and Conditions



Agreement

PlusOne empowers users to coordinate in-person events between people. The following is an agreement between PlusOne and anybody who chooses to use PlusOne’s services. In this document, any use of first-person plural pronouns, including “we,” “us,” and “our” is a direct reference to PlusOne and its team members, including its cofounders and affiliates. Any use of second person pronouns, including “you,” and “your” is a direct reference to any person using our platform. The term platform refers to the application and services associated with PlusOne. By downloading and using PlusOne and its associated services, you hereby accept the following agreement. In this document, the words “agreement” and “terms and conditions” will be used synonymously. Both refer to the contents of this document. Your access and use of this application and its associated services bounds you entirely to the terms of this agreement. Downloading and using this service also makes you completely responsible to abide by any rules or guidelines posted within the service. If you cannot comply with all of the terms and conditions listed, we respectfully request that you do not use this service.



Updates to Agreement

PlusOne reserves the right to update the contents of this agreement at any time. When an update takes place, you will be notified by a push notification or notified directly within the app. You will be presented the option to accept or deny the new terms of service.



Your Account

We reserve the right to suspend, terminate, or alter your account for any reason that we deem necessary. Reasons for this include anything that, at our discretion, poses a threat to the happiness and wellbeing of the PlusOne community at large.



Privacy

We collect the following data on our users: names, email addresses, phone numbers, locations, friends lists with in the app, usernames, comments made on posts, profile pictures, events created and joined, and groups created and joined. PlusOne keeps this information in order to keep a record of users, facilitate communication between users, and communicate directly to users. This information is stored in Firebase, a Google application whose privacy policy adheres to the restrictions of the EU’s GDPR. We have no control and hold no liability for the actions of Firebase and its affiliates.



Content

You are entirely responsible for content posted on our platform. Content includes any information posted in messages, group messages, or event details. You are not permitted to create any content on our platform that may violate the rights of any third party. These rights include publicity rights, privacy rights, contract rights, trademarks and copyrights. We do not assume any obligation for the content of others. That being said, we do reserve the right to take action when we deem it appropriate.



Interactions with Others

PlusOne assumes no responsibility for any offline interactions facilitated through our platform. We do not require background checks or screen the users of our services in any way, nor do we verify the accuracy of any statements made by participants in our platform. PlusOne is not responsible for the conduct or content of any users or their interactions with you. 



Release

You agree that PlusOne and our affiliates hold no liability for any damages, crimes, injuries, consequences, or wrongdoings that may arise from any activities connected to PlusOne. You release us from all demands and claims, of every possible kind, that may take place when using our platform. You wave all benefits and rights

that may be included in any other law of any jurisdiction that may limit the scope of this release. Explicitly, you relinquish all rights you may have under Section 1542 of the California Civil Code or any similar law from another jurisdiction.  In addition, you agree not to hold the organizers of PlusOne events liable for any negligence that may lead to problems, damages, or harm at a PlusOne event. 



Accuracy Warning/Warranty Disclaimer

We assume no liability for the performance of our platform. This includes the accuracy, reliability, and timeliness of our application. We disclaim all possible warranties.



Platform Modifications

In order to maintain and continuously ensure that we provide the most effective services, PlusOne reserves the right to change any part of our platform with or without notifying you.



Third Party Sites/Services

We are integrated with a variety of third party sites and services, including but not limited to Firebase (owned by Google), Twilio, and CoacoaPods. Each integration exists to enhance the user experience. That being said, we have no control and assume no liability for the services, sites, products, or contents of any of these third parties.  Each third party may have their own terms and conditions and or privacy policies. Any use of those third parties must be in compliance with their terms and policies. 



User Liability

If we get sued because of anything related to your use of our platform, you agree to reimburse us entirely.You consent to hold all of PlusOne and its affiliates harmless if any claims are made against you by a third party. These claims include any misuse or abuse of this platform and your violation of any of the rights, laws, statutes, ordinances, or regulations of a third party.



Liability Limitation

You agree that PlusOne and its affiliates hold zero liability for any intentional, accidental, direct, indirect, or special damages related to the use of our platform. This includes any tangible or intangible losses. Even if we are aware of possible threats and damages, we assume no liability for them. We hold no liability for damages or losses that may have come in the process of coordinating, during, or after a PlusOne event. This includes the transportation to and from an event, injuries during an event, and misrepresentation of an event.



Agreement to Try to Engage in Informal Resolutions

You agree to engage PlusOne’s team in discussions before making any other forms of claims related to the usage of PlusOne. You agree to genuinely attempt to resolve any issues directly with us as your first course of action.



Intellectual Property

PlusOne’s trademarks, logos, interface, service symbols, slogans, and other content is the intellectual property of our team. The platform and all of its contents are the intellectual property of PlusOne or its licensors. You agree not to infringe upon any of our intellectual property.
